Can I work in the United States on a TN Visa?

If you are a Canadian Citizen, you can be eligible to work in the United States on a TN Visa. However, just because you are a Canadian citizen does not mean you are automatically eligible to obtain a TN Visa – there are many other criteria that must be met before you are eligible at all.

Requirements for a TN Visa

1. You must be a Canadian citizen and be able to prove this with a valid Canadian passport or birth certificate.

2. You must demonstrate that your job occupation appears on the list of approved NAFTA occupations for the TN Visa.

3. You need to have your job offer from your American employer formatted for the TN Visa, which is a petition for a TN visa on your behalf that provides all the details of your job position.

4. You need to prove that you are qualified for the job you’ve been offered with information about your employment history, your education and your resume. Providing employer references may also be a good idea depending on the type of work you do.

Applying for a TN Visa

You can apply for a TN visa at the United States border or at a port of entry like an airport. However, it is absolutely necessary that all of your documentation is complete, readable and in order.

One of the best ways to set yourself up for success when you are planning on applying for a TN Visa is to have your supporting documentation reviewed by a licensed immigration lawyer or attorney.
